Tento z\u00e1kon vstoup\u00ed v platnost 1.4.2024. Od tohoto dne se v\u00fdrazn\u011b zm\u011bn\u00ed legislativa vztahuj\u00edc\u00ed se k problematice mobiln\u00edch dom\u016f.<\/h3>\n<h3>Prvn\u00ed z\u00e1sadn\u00ed rozd\u00edl je vid\u011bt samotn\u00e9 definici stavby. V sou\u010dasnosti platn\u00fd stavebn\u00ed z\u00e1kon \u010d.2 \u010d. 56\/1976 Sb. v \u00a7 43, \u010dl\u00e1nek 1, definuje stavbu n\u00e1sledovn\u011b:\u00a0<strong>Stavba je stavebn\u00ed konstrukce postaven\u00e1 stavebn\u00edmi pracemi ze stavebn\u00edch v\u00fdrobk\u016f, kter\u00e1 je pevn\u011b spojena se zem\u00ed nebo jej\u00ed\u017e osazen\u00ed vy\u017eaduje \u00fapravu podkladu.<\/strong><\/h3>\n<p>&nbsp;<\/p>\n<h4>Pevn\u00fdm spojen\u00edm se zem\u00ed se rozum\u00ed:<\/h4>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>spojen\u00ed pevn\u00fdm z\u00e1kladem,<\/li>\n<li>upevn\u011bn\u00ed strojn\u00edmi sou\u010d\u00e1stkami nebo svarem o pevn\u00fd z\u00e1klad v zemi nebo o jinou stavbu,<\/li>\n<li>ukotven\u00ed piloty nebo lany s kotvou v zemi nebo na jin\u00e9 stavb\u011b,<\/li>\n<li>p\u0159ipojen\u00ed na s\u00edt\u011b a za\u0159\u00edzen\u00ed technick\u00e9ho vybaven\u00ed \u00fazem\u00ed,<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>Nov\u00fd Z\u00e1kon o v\u00fdstavb\u011b \u010d.201\/2022 Zz (d\u00e1le jen \u201eZ\u00e1kon\u201c) v \u00a72, \u010dl\u00e1nek 1 definuje stavbu n\u00e1sledovn\u011b:<\/p>\n<p><strong>Stavba je stavebn\u00ed d\u00edlo zhotoven\u00e9 stavebn\u00edmi pracemi, s vymezenou \u00fa\u010delovou funkc\u00ed, kter\u00e9 je um\u00edst\u011bno na pozemku, trval\u00e9 konstrukci nebo jin\u00e9 stavb\u011b, kter\u00e1 je samostatn\u011b u\u017e\u00edv\u00e1n\u00ed schopna, bez ohledu na zp\u016fsob osazen\u00ed nebo upevn\u011bn\u00ed a na druh pou\u017eit\u00e9ho materi\u00e1lu.<\/strong><\/p>\n<p>Nov\u00fd Z\u00e1kon tak\u00e9 hned v \u00a71, \u010dl\u00e1nek 2, bod a) \u0159\u00edk\u00e1, \u017ee \u201eZ\u00e1kon se vztahuje i na: v\u00fdrobek dovezen\u00fd na m\u00edsto osazen\u00ed ji\u017e smontovan\u00fd nebo na m\u00edst\u011b osazen\u00ed zkompletovan\u00fd z dovezen\u00fdch d\u00edlc\u016f, m\u00e1-li plnit \u00fa\u010del stavby (d\u00e1le jen \u201esmontovan\u00fd v\u00fdrobek\u201c)\u201c<\/p>\n<p>Na prvn\u00ed pohled je vid\u011bt z\u00e1sadn\u00ed rozd\u00edl sou\u010dasn\u00e9 definice stavby a definice stavby po 1.4.2024.\u00a0<strong>Dnes v\u0161eobecn\u011b pou\u017e\u00edvan\u00fd argument \u017ee mobiln\u00ed d\u016fm nen\u00ed stavba nebo\u0165 nen\u00ed pevn\u011b spojen se zem\u00ed zcela ztrat\u00ed relevanci.<\/strong><\/p>\n<p>Stavbou se bude ch\u00e1pat ka\u017ed\u00e9 stavebn\u00ed d\u00edlo zhotoven\u00e9 stavebn\u00edmi pracemi, s vymezenou \u00fa\u010delovou funkc\u00ed, bez ohledu na zp\u016fsob osazen\u00ed nebo upevn\u011bn\u00ed a na druh pou\u017eit\u00e9ho materi\u00e1lu.<\/p>\n<p>V praxi to bude znamenat, \u017ee se definitivn\u011b ukon\u010d\u00ed polemiky se stavebn\u00edmi \u00fa\u0159ady \u010di se u mobiln\u00edho domu, dovezen\u00e9ho kontejneru nebo kontejnerov\u00e9ho domu jedn\u00e1 o stavbu nebo ne.<strong>\u00a0V\u0161echny mobiln\u00ed a kontejnerov\u00e9 domy a\u0165 u\u017e s podvozkem nebo bez, a\u0165 u\u017e na m\u00edst\u011b postaven\u00e9 nebo dovezen\u00e9, pln\u00edc\u00ed funkci stavby, budou stavebn\u00edmi \u00fa\u0159ady pova\u017eov\u00e1ny za stavby.<\/strong><\/p>\n<p>&nbsp;<\/p>\n<h4>Co bude s dnes ji\u017e existuj\u00edc\u00edmi mobiln\u00edmi nebo kontejnerov\u00fdmi domy, kter\u00e9 byly p\u0159\u00edpadn\u011b je\u0161t\u011b budou postaveny do 31.3.2024?<\/h4>\n<p>Existuje velk\u00e9 mno\u017estv\u00ed mobiln\u00edch nebo kontejnerov\u00fdch dom\u016f, kter\u00e9 existuj\u00ed na z\u00e1klad\u011b tvrzen\u00ed, \u017ee se nejedn\u00e1 o stavby, proto\u017ee nejsou pevn\u011b spojeny se zem\u00ed nebo s p\u0159\u00edpojkami. Stavebn\u00ed \u00fa\u0159ady \u010dasto situaci ne\u0159e\u0161ily s ohledem na r\u016fzn\u00e9 v\u00fdklady sou\u010dasn\u00e9ho z\u00e1kona a potenci\u00e1ln\u011b mo\u017en\u00e9 spory s vlastn\u00edky mobiln\u00edch dom\u016f kon\u010d\u00edc\u00ed tvrzen\u00edm proti tvrzen\u00ed.<\/p>\n<p><strong>Nov\u00fd Z\u00e1kon d\u00e1v\u00e1 stavebn\u00edm \u00fa\u0159ad\u016fm jasn\u00e1 pravidla definov\u00e1n\u00ed mobiln\u00edho nebo kontejnerov\u00e9ho domu jako stavby a tak\u00e9 jasn\u00e9 n\u00e1stroje jak situaci \u0159e\u0161it.<\/strong><\/p>\n<p><strong>V moment\u011b, kdy stavebn\u00ed \u00fa\u0159ad mobiln\u00ed nebo kontejnerov\u00fd d\u016fm definuje podle nov\u00e9ho Z\u00e1kona za stavbu, ve v\u011bt\u0161in\u011b p\u0159\u00edpad\u016f tedy za stavbu postavenou bez stavebn\u00edho povolen\u00ed, m\u00e1 pr\u00e1vo ve smyslu \u00a763 \u017e\u00e1dat od vlastn\u00edk\u016f vypo\u0159\u00e1d\u00e1n\u00ed staveb postaven\u00fdch bez stavebn\u00edho povolen\u00ed formou osv\u011bd\u010den\u00ed.<\/strong><\/p>\n<p>Proces osv\u011bd\u010den\u00ed st\u00e1vaj\u00edc\u00ed stavby m\u00e1 mnoho n\u00e1le\u017eitost\u00ed stavebn\u00edho a kolauda\u010dn\u00edho \u0159\u00edzen\u00ed, vy\u017eaduje se krom\u011b dolo\u017een\u00ed vlastnick\u00fdch pr\u00e1v a dokumentace skutkov\u00e9ho stavu i dolo\u017een\u00ed stanovisek dot\u010den\u00fdch org\u00e1n\u016f, co\u017e bude velmi \u010dasto problematick\u00e9, proto\u017ee v\u011bt\u0161ina mobiln\u00edch a kontejnerov\u00fdch dom\u016f se osadila hlavn\u011b z d\u016fvodu nemo\u017enosti na dan\u00e9m m\u00edst\u011b z\u00edskat stavebn\u00ed povolen\u00ed. Pokud vlastn\u00edk takov\u00e9 osv\u011bd\u010den\u00ed nez\u00edsk\u00e1, stavebn\u00ed \u00fa\u0159ad bude moci bez probl\u00e9m\u016f as oporou v Z\u00e1kon\u011b na\u0159\u00eddit odstran\u011bn\u00ed stavby. Dokonce pokud by se vlastn\u00edk zatajoval a nekomunikoval a nepo\u017e\u00e1dal o osv\u011bd\u010den\u00ed stavby, stavebn\u00ed \u00fa\u0159ad m\u016f\u017ee stejn\u011b na\u0159\u00eddit stavbu odstranit.<\/p>\n<p>Z \u00a7 63 vyb\u00edr\u00e1me d\u016fle\u017eit\u00e1 ustanoven\u00ed :<\/p>\n<p>(1) Stavebn\u00ed \u00fa\u0159ad na \u017e\u00e1dost vlastn\u00edka stavby osv\u011bd\u010d\u00ed zp\u016fsobilost stavby k provozu, jde-li o stavbu zhotovenou bez stavebn\u00edho povolen\u00ed nebo bez ohl\u00e1\u0161en\u00ed, nebo stavbu u\u017e\u00edvanou bez kolauda\u010dn\u00edho rozhodnut\u00ed \u010d. 50\/1976 Sb. o \u00fazemn\u00edm pl\u00e1nov\u00e1n\u00ed a stavebn\u00edm \u0159\u00e1du (stavebn\u00ed z\u00e1kon) ve zn\u011bn\u00ed pozd\u011bj\u0161\u00edch p\u0159edpis\u016f od 1. ledna 1990 do 31. b\u0159ezna 2024 a vlastn\u00edk stavby prok\u00e1\u017ee, \u017ee<\/p>\n<ol>\n<li>a) stavba sv\u00fdm stavebn\u011btechnick\u00fdm stavem a vybaven\u00edm odpov\u00edd\u00e1 z\u00e1kladn\u00edm po\u017eadavk\u016fm na stavby a \u00fa\u010delu, k n\u011bmu\u017e ji vlastn\u00edk nep\u0159etr\u017eit\u011b bez nedostatk\u016f u\u017e\u00edv\u00e1, a stavebn\u00ed \u00fa\u0159ad v \u0159\u00edzen\u00ed zjist\u00ed, \u017ee stavba neohro\u017euje \u017eivot,<\/li>\n<li>b) je vlastn\u00edkem pozemku nebo m\u00e1 jin\u00e9 pr\u00e1vo k pozemku a do\u0161lo k uspo\u0159\u00e1d\u00e1n\u00ed pozemku podle zvl\u00e1\u0161tn\u00edch p\u0159edpis\u016f,<\/li>\n<li>e) ke stavb\u011b je vypracov\u00e1na dokumentace skutkov\u00e9ho stavu st\u00e1vaj\u00edc\u00ed stavby pro \u00fa\u010dely kolaudace nepovolen\u00e9 stavby, pokud si vypracov\u00e1n\u00ed takov\u00e9 dokumentace stavebn\u00ed \u00fa\u0159ad vy\u017e\u00e1d\u00e1.<\/li>\n<\/ol>\n<p>(3) Vlastn\u00edk stavby je povinen podat \u017e\u00e1dost o p\u0159ezkoum\u00e1n\u00ed zp\u016fsobilosti nepovolen\u00e9 stavby k provozu. P\u0159\u00edlohou \u017e\u00e1dosti je dokumentace potvrzuj\u00edc\u00ed skute\u010dnosti podle odstavce 1 v\u010detn\u011b z\u00e1vazn\u00fdch stanovisek dot\u010den\u00fdch org\u00e1n\u016f.<\/p>\n<p>(4) Prok\u00e1\u017ee-li vlastn\u00edk stavby zp\u016fsobilost stavby k provozu podle odstavce 1, stavebn\u00ed \u00fa\u0159ad vyd\u00e1 ke stavb\u011b osv\u011bd\u010den\u00ed o zp\u016fsobilosti stavby k provozu. Osv\u011bd\u010den\u00ed o zp\u016fsobilosti stavby k provozu m\u00e1 \u00fa\u010dinky kolauda\u010dn\u00edho osv\u011bd\u010den\u00ed podle tohoto z\u00e1kona<\/p>\n<p>(5) Neprok\u00e1\u017ee-li vlastn\u00edk stavby spln\u011bn\u00ed podm\u00ednek podle odstavce 1, stavebn\u00ed \u00fa\u0159ad na\u0159\u00edd\u00ed odstran\u011bn\u00ed stavby. Neprok\u00e1\u017ee-li vlastn\u00edk stavby u\u017e\u00edv\u00e1n\u00ed stavby bez stavebn\u011b technick\u00fdch a provozn\u00edch nedostatk\u016f, stavebn\u00ed \u00fa\u0159ad na\u0159\u00edd\u00ed neodkladn\u00e9 stavebn\u00ed \u00fapravy. Neuskute\u010dn\u00ed-li vlastn\u00edk stavby na\u0159\u00edzen\u00e9 neodkladn\u00e9 stavebn\u00ed \u00fapravy a neodstran\u00ed vadn\u00fd stav, stavebn\u00ed \u00fa\u0159ad na\u0159\u00edd\u00ed odstran\u011bn\u00ed stavby.<\/p>\n<p>(7) Nepod\u00e1-li vlastn\u00edk stavby \u017e\u00e1dost o p\u0159ezkoum\u00e1n\u00ed zp\u016fsobilosti nepovolen\u00e9 stavby k provozu ani na v\u00fdzvu stavebn\u00edho \u00fa\u0159adu, stavebn\u00ed \u00fa\u0159ad na\u0159\u00edd\u00ed odstran\u011bn\u00ed stavby.<\/p>\n<p>&nbsp;<\/p>\n<h4>Jak\u00e9 mo\u017enosti tedy z\u016fstanou pro z\u00e1jemce o mobiln\u00ed bydlen\u00ed?<\/h4>\n<p>Z pohledu mobiln\u00edch dom\u016f je d\u016fle\u017eit\u00fdm ustanoven\u00edm nov\u00e9ho Z\u00e1kona P\u0159\u00edloha \u010d.2 (Seznam drobn\u00fdch staveb), odstavec 1, bod j), kte\u0159\u00ed \u0159\u00edk\u00e1:<\/p>\n<p><strong>Za drobnou stavbu bude pova\u017eov\u00e1n: d\u016fm na strom\u011b a mobiln\u00ed d\u016fm do 25 m2 zastav\u011bn\u00e9 plochy v zastav\u011bn\u00e9m \u00fazem\u00ed; za mobiln\u00ed d\u016fm se nepova\u017euje obytn\u00e9 vozidlo s p\u0159id\u011blen\u00fdm eviden\u010dn\u00edm \u010d\u00edslem vozidla.<\/strong><\/p>\n<p>Nov\u00fd z\u00e1kon tedy umo\u017e\u0148uje osazen\u00ed mobiln\u00edho domu jako Drobnou stavbu, co\u017e v\u0161ak s sebou nese n\u011bkolik z\u00e1sadn\u00edch omezen\u00ed, ale i jist\u00e1 pozitiva:<\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>maxim\u00e1ln\u00ed zastav\u011bn\u00e1 plocha mobiln\u00edho domu bude 25 m2<\/li>\n<li>mobiln\u00ed d\u016fm mus\u00ed b\u00fdt um\u00edst\u011bn v zastav\u011bn\u00e9m \u00fazem\u00ed (v intravil\u00e1nu)<\/li>\n<li>na osazen\u00ed Drobn\u00e9 stavby tak jako v sou\u010dasnosti bude posta\u010dovat ohl\u00e1\u0161en\u00ed Drobn\u00e9 stavby<\/li>\n<li>obytn\u00e9 vozidlo s p\u0159id\u011blen\u00fdm eviden\u010dn\u00edm \u010d\u00edslem vozidla nebude pova\u017eov\u00e1no za mobiln\u00ed d\u016fm a tedy ani za drobnou stavbu<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><strong>Je t\u0159eba podotknout, \u017ee velmi d\u016fle\u017eit\u00fdm je uveden\u00ed informace, \u017ee obytn\u00e9 vozidlo s p\u0159id\u011blen\u00fdm eviden\u010dn\u00edm \u010d\u00edslem vozidla se nepova\u017euje za mobiln\u00ed d\u016fm a tedy ani za drobnou stavbu. Znamen\u00e1 to tedy, \u017ee takov\u00fd v\u016fz pod stavebn\u00ed z\u00e1kon nespad\u00e1. Stavebn\u00ed \u00fa\u0159ady dostanou tak\u00e9 siln\u00fd n\u00e1stroj s mo\u017enost\u00ed na\u0159izovat odstran\u011bn\u00ed mobiln\u00edch a kontejnerov\u00fdch dom\u016f, kter\u00e9 nejsou zkolaudov\u00e1ny nebo neprojdou procesem osv\u011bd\u010den\u00ed<\/p>\n<p>Za\u0159azen\u00ed mobiln\u00edch dom\u016f do kategorie Drobn\u00fdch staveb a omezen\u00ed na 25 m2 zp\u016fsob\u00ed pokles z\u00e1jmu v segmentu velk\u00fdch mobiln\u00edch dom\u016f p\u0159ev\u00e1\u017een\u00fdch na kamionech, jeliko\u017e ka\u017ed\u00fd takov\u00fd mobiln\u00ed d\u016fm stavbou a bude jej t\u0159eba kolaudovat.<\/p>\n<p><strong>Jeliko\u017e obytn\u00e1 vozidla s p\u0159id\u011blenou SPZ nebudou pova\u017eov\u00e1na za stavby, net\u00fdk\u00e1 se jejich stavebn\u00ed z\u00e1kon a nevy\u017eaduj\u00ed se povolovac\u00ed procesy, lze o\u010dek\u00e1vat v\u00fdznamn\u00fd n\u00e1r\u016fst jejich vyu\u017e\u00edv\u00e1n\u00ed v podob\u011b r\u016fzn\u00fdch obytn\u00fdch vozidel, karavan\u016f, tiny hous\u016f s SPZ a tak\u00e9 n\u00e1r\u016fst po\u010dtu r\u016fzn\u00fdch p\u0159ed\u011bl\u00e1vek jin\u00fdch vozidel, nebo dod\u00e1vek na kr\u00e1tkodob\u00e9 bydlen\u00ed a cestov\u00e1n\u00ed.<\/strong><\/p>\n<p>D\u016fle\u017eit\u00fdm aspektem obytn\u00fdch vozidel s p\u0159id\u011blenou SPZ je jejich celkov\u00e1 hmotnost kter\u00e1 zpravidla nesm\u00ed p\u0159es\u00e1hnout 3,5 tuny. Tato skute\u010dnost bude limitovat jejich vybaven\u00ed standardn\u00edm t\u011b\u017ek\u00fdm n\u00e1bytkem a spot\u0159ebi\u010di a jejich celoro\u010dn\u00ed vyu\u017e\u00edv\u00e1n\u00ed bude tak\u00e9 omezeno z d\u016fvodu nutnosti masivn\u00edho zateplen\u00ed pro kter\u00e9 v t\u011bchto vozidlech nen\u00ed prostor.<\/p>\n<p><strong>Za\u0159azen\u00ed mobiln\u00edch dom\u016f do kategorie Drobn\u00fdch staveb s limitem 25m2 zastaven\u00e9 plochy as maxim\u00e1ln\u00ed v\u00fd\u0161kou 5 m, z\u00e1konit\u011b p\u0159ivede investory k \u00favah\u00e1m zda nebude m\u00edt v\u011bt\u0161\u00ed smysl si rad\u011bji nechat Drobnou stavbu postavit a eliminovat t\u00edm nedostatky, kter\u00e9 maj\u00ed mobiln\u00ed domy kv\u016fli pot\u0159eb\u011b jejich transportu.
